Ventura Arrest Disclosure Under California Law
Government Code 7923.610 sets out what arrest information must be public. The Ventura Police Department and Ventura County Sheriff are both covered. Required disclosures include the arrested person's full name, occupation, physical description, date of birth, arrest and booking dates, arrest location, surrounding circumstances, bail amount, release or custody status, and all charges. Warrants from other places, parole holds, and probation holds must also be shared.
Exceptions are narrow. The agency can hold back a specific detail if releasing it would endanger someone involved in the investigation or if it would hurt the investigation itself. Otherwise, the information is public. This law became effective January 1, 2023, and applies to every Ventura arrest going forward.

Sealing Ventura Arrest Records
California law provides ways to seal arrest records when no conviction occurred. Penal Code 851.87 lets you file a petition with the court to seal a Ventura arrest that did not lead to a guilty finding. If the court grants the petition, the record is sealed. Most background checks will not show it. You can legally state you were not arrested for that charge. Ventura County Superior Court handles the petition process.

Booking Photos From Ventura Arrests
Civil Code 1798.91.1 protects people whose booking photos end up on commercial websites. It is illegal for those sites to charge a fee to remove the photo. Anyone whose Ventura booking photo appears on one of these sites can pursue damages of $1,000 or more per violation. Attorney fees and costs are also recoverable.
Penal Code 13665 restricts law enforcement from posting booking photos on social media for nonviolent offenses. This covers both the Ventura Police Department and the Ventura County Sheriff. Exceptions apply when a person is a fugitive or when there is an urgent public safety concern.
