The Carlsbad Police Department handles law enforcement in the city, but the county sheriff runs the jail system. When someone is arrested in Carlsbad, they get booked into the county system. The sheriff's "Who's In Jail" tool lets you search for current inmates by name. It is free and open to the public. Carlsbad sits in northern San Diego County and has its own police force, but the arrest booking data flows into the same county database as every other city in the area.

Carlsbad Arrest Record Public Access

California law requires law enforcement to share arrest details with the public. Government Code 7923.610 lists what must be disclosed: the arrested person's full name, occupation, physical description, date of birth, times and dates for both the arrest and booking, arrest location, circumstances of the arrest, bail amount, release status, and all charges. Carlsbad PD and the San Diego Sheriff both comply with this. They can only withhold a specific item if it would endanger someone or harm an ongoing investigation.

The California legislature's website has the full text of the laws that govern arrest record access across the state.

Sealing Carlsbad Arrest Records

If you were arrested in Carlsbad and the case did not end in a conviction, you may be able to seal the arrest. Penal Code 851.87 lets you petition San Diego County Superior Court. When the court grants the petition, the arrest is sealed. Most background checks will not show it. You can legally state that you were not arrested for that charge.

There is also automatic relief. AB 1076 set up a system where the DOJ reviews records every month. Misdemeanor arrests from January 2021 onward that ended in dismissal or had no case filed within a year can be cleared automatically. You do not need to petition the court or file any paperwork. The DOJ does it on its own. This covers Carlsbad arrests that go through the San Diego County court system.
